Ohio Supreme Court Clarifies Application of Amendment to Postjudgment Interest Statute

The Supreme Court of Ohio recently held, in the case of Maynard v. Eaton Corp.,1 that the amendment to R.C. § 1343.03(A), which was enacted by 2004 Sub.H.B. No. 212 (“H.B. 212”)2 and became effective on June 2, 2004, adjusts the statutory rate of postjudgment interest on a final judgment entered by a trial court when the case is pending on appeal on the amendment’s effective date.   Submitted by Ali Razzaghi.

Most of our lender clients charge fees when a loan is initiated.
